“WhimNote: AI Notes Application”

These Terms of Service (“Terms”) govern your access to and use of the WhimNote: AI Notes (随心记：AI笔记) application and related services (the “Service”). By downloading, accessing or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.
WhimNote: AI Notes is an AI-powered multimodal note-taking application that lets you capture text, voice recordings, images and documents, and provides transcription, summarization, image understanding, conversational and search features. Features may change over time, and some features may be offered as part of a paid subscription.
You may sign in using Sign in with Apple or Google Sign-In. You are responsible for maintaining the confidentiality of your account and for all activity that occurs under it. You must provide accurate information and must be at least the minimum age permitted by applicable law to use the Service.
You agree not to misuse the Service, including by attempting to access it through unauthorized means, disrupting its operation, reverse engineering it except as permitted by law, or using it to violate the rights of others.
Our handling of personal data is described in our Privacy Policy, which forms part of these Terms. By using the Service you consent to that handling.
The Service may rely on third-party services, including sign-in providers (Apple, Google), AI providers, payment processors and cloud infrastructure. Your use of those services may be subject to their own terms and policies.
Paid features may be offered as an auto-renewing subscription through Google Play or the App Store. The price, billing period, renewal terms and any trial are shown on the store checkout page before you confirm. The subscription renews automatically unless you cancel it before the end of the current period. You can manage or cancel it at any time in your Google Play or App Store account settings.
Deleting your WhimNote account does not cancel a subscription purchased through a store. Cancel it separately in the store to stop future charges. Refunds are handled under the applicable store's refund policy. We do not receive or store your payment card details.
The Service is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including fitness for a particular purpose, accuracy of AI-generated output, or non-infringement. You are responsible for reviewing AI-generated content before relying on it.
To the maximum extent permitted by law, WhimNote shall not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits or goodwill arising out of or relating to your use of the Service.
You may stop using the Service and request deletion of your account at any time. We may suspend or terminate access if you violate these Terms or if required by law.
We may update these Terms from time to time. The revised Terms will be posted on this page with an updated effective date. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
